FMCSA's Crash Preventability Demonstration Program is now accepting Requests for Data Review (RDR).

If you have an eligible crash that occurred between June 1, 2017, and July 31, 2019, you may submit an RDR with compelling evidence to show the crash was Not Preventable. The Demonstration Program will stop accepting requests on September 30, 2019. During the Demonstration Program, eligible crashes are limited to this list.

  • When the commercial motor vehicle (CMV) was struck by a motorist driving under the influence (or related offense)
  • When the CMV was struck by a motorist driving the wrong direction
  • When the CMV was struck in the rear
  • When the CMV was struck while it was legally stopped or parked, including when the vehicle is unattended
  • When the CMV struck an individual committing, or attempting to commit, suicide by stepping or driving in front of the CMV
  • When the CMV sustained disabling damage after striking an animal in the roadway
  • When the crash was the result of an infrastructure failure, or falling trees, rocks, or debris
  • When the CMV was struck by cargo or equipment from another vehicle

During the Demonstration Program, if FMCSA reviews a crash RDR and makes a preliminary determination that the crash is Not Preventable, anyone with information to refute a proposed Not Preventable determination may submit it through DataQs before FMCSA makes a final determination. Use the table in the "Public Provides Input" section below to submit your evidence.

On August 5, 2019, FMCSA announced a proposal for the Crash Preventability Determination Program in the Federal Register. This proposal would continue to allow motor carriers and drivers to submit Requests for Data Review and police accident reports to FMCSA to show that crashes were Not Preventable for 15 specific crash types.

Motor carriers and drivers are encouraged review the proposal and provide comments. The comments docket will be open for 60 days. For more information about the proposal, including more detail on how to submit comments, visit FMCSA’s website.

1. Carriers Submit Requests

To submit an RDR, visit My DataQs, and click on "Add a Request." Select "Crash Event," then select "Crash could not be prevented."

Follow the prompts to search for the qualified crash record, fill in the required information, and provide any supporting documents you may have.

Once complete, review your submission, and then submit your request.

Note that you must have a DataQs account in order to submit an RDR.
